ROSE APPOINTMENT REMEDY ?

Dear Mr. Lough: It appears that you are not planning to remedy the illegal appointment of Diane Rose. After repeated warnings from the public, the Deputy District Attorney, The San Diego Reader, The Voice of San Diego, SaveIB.com and your own cozy friends at the Eagle Times, you went ahead and ratified the minutes of the meeting where Diane Rose was appointed…..making it official in the eyes of the District Attorney. We tried to warn you!

While you may feel that you are immune from prosecution under the current District Attorney, you might not be immune from prosecution by other agencies? I urge you to immediately set aside the appointment of Diane Rose and start the process over again. If you should decide to start the process, please be sure to make it appear to be open and fair. I’m sure you will still reach the same conclusions, but at least make it look and smell legal. You may be able to stall and extend a challenge on the Brown Act Violations in Civil Court, however when your client’s have been recalled and are in jail, who will pay your fees? You’re going to be fired too and hopefully get a cell right next to Gary Brown’s. We know that you counsel other cities on how to avoid conflicts with the Brown Act. We know that you have the latest information on how to circumvent the Brown act from the League of California Cities Attorney Group. Conspiracy to committ a misdemenor is a felony. Perhaps you’ve had such a long lucky clean run that you forgot your oath?  I promise to come visit you in jail.
